Professional title: Software Developer Small-business VAT exemption pursuant to Section 19 of the German Value Added Tax Act (UStG)
1. Scope
These Terms apply to the use of MenuMRR.
MenuMRR is distributed through Apple’s Mac App Store. Purchases, payments, refunds, downloads, and use of the Mac App Store are also subject to Apple’s applicable terms and licence conditions.
Mandatory consumer-protection rights remain unaffected.
2. Description of the Application
MenuMRR is a macOS menu bar application that retrieves and displays revenue information from supported third-party services.
Supported services may include:
- Stripe;
- Lemon Squeezy; and
- Apple App Store Connect.
Depending on the connected services and available data, MenuMRR may display:
- estimated monthly recurring revenue (MRR);
- month-over-month changes;
- revenue broken down by provider;
- current-month App Store revenue; and
- other related revenue information.
The exact functionality and supported providers are described in the current App Store listing.
3. Third-Party Accounts and API Access
Certain functions require you to connect accounts or provide API credentials for third-party services.
You are responsible for:
- using credentials that you are authorised to use;
- configuring appropriate access permissions;
- complying with the terms of the connected provider; and
- protecting access to your accounts and credentials.
Where supported, MenuMRR should be used with restricted or read-only credentials whenever possible.
MenuMRR does not require permission to modify your Stripe account for its standard revenue-display functionality.
4. Revenue Calculations
MenuMRR calculates and displays revenue information based on data made available by connected providers.
For example, calculations may be based on:
- active Stripe subscription items;
- active Lemon Squeezy subscriptions;
- App Store financial reports;
- subscriptions;
- consumable purchases; and
- non-consumable purchases.
Displayed values may differ from accounting records, bank payouts, tax reports, or provider dashboards due to reporting delays, refunds, taxes, fees, currency differences, subscription changes, incomplete data, or differences in calculation methods.
MenuMRR does not guarantee that displayed MRR or revenue figures exactly match the accounting definition or reporting method used by you or a third party.
5. Currency Handling
MenuMRR does not automatically combine values from different currencies using an assumed exchange rate unless such functionality is expressly introduced.
Where provider data uses a currency different from the selected display currency, MenuMRR may exclude, separate, or identify that amount rather than silently converting it.
You are responsible for applying any currency conversions required for your bookkeeping, tax, or financial reporting.
6. Data Availability
MenuMRR depends on information supplied by third-party services.
Data may be delayed, incomplete, unavailable, or changed by the relevant provider.
In particular, Apple financial reports may not become available immediately.
We do not guarantee that all connected providers will provide current data at any particular time or that MenuMRR will always be able to retrieve it.
7. No Financial, Accounting, Tax, or Legal Advice
MenuMRR is an informational software tool.
It does not provide:
- accounting advice;
- tax advice;
- investment advice;
- financial advice; or
- legal advice.
Displayed MRR, revenue figures, trends, comparisons, and provider breakdowns should not be used as the sole basis for accounting, tax filings, financial statements, investment decisions, valuations, forecasts, or other important decisions.
You are responsible for verifying relevant figures using the official records of Stripe, Lemon Squeezy, Apple, your bank, your accounting system, or other authoritative sources.
8. Licence
Subject to payment of any applicable purchase price and compliance with these Terms and Apple’s applicable rules, you receive a limited, non-exclusive, non-transferable right to use MenuMRR on compatible Apple devices associated with your App Store account.
The application is licensed, not sold.
You may not unlawfully copy, redistribute, sublicense, reverse engineer, circumvent technical protection measures, or otherwise use the application contrary to applicable law or Apple’s terms.
9. Purchase and Refunds
Where MenuMRR is offered as a paid application, purchases are processed through Apple’s Mac App Store.
The price shown by Apple at the time of purchase applies.
Payment processing, billing, cancellations, and refunds are generally handled by Apple.
Statutory consumer rights remain unaffected.
10. Availability and Third-Party Services
MenuMRR depends on APIs, authentication systems, reports, and infrastructure operated by third parties.
Functionality may be affected by:
- provider outages;
- API changes;
- authentication changes;
- rate limits;
- reporting delays;
- changes to data formats;
- removal or modification of API functionality;
- macOS updates; or
- other circumstances outside our control.
We do not guarantee uninterrupted availability or permanent compatibility with any third-party service.
11. Security and Credentials
MenuMRR is designed to store supported API credentials securely using the macOS Keychain.
You remain responsible for securing:
- your Mac;
- your macOS user account;
- connected third-party accounts;
- API credentials; and
- other access credentials.
If you believe a credential has been compromised, you should revoke or replace it directly through the relevant provider.
12. Updates
We may provide updates to:
- fix errors;
- improve performance;
- maintain compatibility with macOS;
- adapt to changes in third-party APIs;
- add or remove supported providers; or
- improve existing functionality.
We do not guarantee that MenuMRR will support every provider or API indefinitely.
Mandatory statutory obligations concerning digital products remain unaffected.
13. Prohibited Use
You may not use MenuMRR:
- for unlawful purposes;
- with accounts or credentials you are not authorised to access;
- to circumvent provider security measures;
- to interfere with the application or connected services;
- to infringe third-party rights; or
- in violation of applicable provider or Apple terms.
14. Liability
We are liable without limitation in cases of intent or gross negligence, for injury to life, body, or health, under applicable product-liability law, where a guarantee has expressly been given, and in other cases where liability cannot legally be limited.
In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damage typical for this type of contract.
Mandatory statutory liability and consumer rights remain unaffected.
15. Relationship with Third-Party Providers
MenuMRR is an independent application.
It is not affiliated with, endorsed by, sponsored by, or operated by Stripe, Lemon Squeezy, Apple Inc., or their respective affiliates unless expressly stated otherwise.
All third-party names, trademarks, services, and data remain subject to the rights and terms of their respective owners.
16. Changes and Termination
You may stop using and uninstall MenuMRR at any time.
We may update these Terms where reasonably necessary due to changes to MenuMRR, applicable law, Apple’s platform, connected providers, security requirements, or technical functionality.
Changes will not retroactively remove mandatory consumer rights.
17. Governing Law and Dispute Resolution
The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law does not deprive them of mandatory protections provided by the law of the country in which they have their habitual residence.
Mandatory rules regarding jurisdiction remain unaffected.
We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board, unless a legal obligation to participate applies.
