2. Scope and App Store terms
These Terms and Conditions apply to the use of the MenuPlinko macOS application provided by Max Anton Schneider (the “Provider”).
MenuPlinko is distributed through Apple's Mac App Store. Your acquisition and use of the App are also subject to the applicable Apple Media Services Terms and Conditions, App Store Usage Rules, and Apple's Licensed Application End User License Agreement (“Standard EULA”). Unless a custom EULA is displayed by Apple for MenuPlinko, Apple's Standard EULA applies to the licence for the App.
These Terms supplement the applicable Apple terms and Standard EULA. They do not limit mandatory consumer rights or rights granted under Apple's applicable terms. If a provision conflicts with mandatory law or an applicable Apple term that takes precedence, that provision applies only to the legally permitted extent.
3. Function of the App
MenuPlinko is a menu-bar productivity utility that helps users make everyday choices. Users can create lists of options, start a Plinko drop, and receive a locally generated random result. The App also allows users to organise multiple lists and customise visual and sound settings.
Random results are intended as a convenience for ordinary personal and productivity choices. They are not professional advice and must not be used as the sole basis for safety-critical, medical, legal, financial, employment, or other high-impact decisions.
4. Technical requirements
Use of MenuPlinko requires a compatible Mac and a supported version of macOS. Downloading, purchasing, and updating the App may require an Apple Account and access to the Mac App Store.
Users are responsible for maintaining a compatible device, installing available macOS and App updates, and protecting access to their Mac and Apple Account.
5. Licence and permitted use
The licence to use MenuPlinko is governed by Apple's applicable Standard EULA unless a custom EULA is provided through the App Store. Subject to that licence, MenuPlinko may be used for personal or internal business purposes on devices permitted by the App Store Usage Rules.
Except where applicable law expressly permits otherwise, users must not reproduce, redistribute, sell, rent, sublicense, reverse engineer, circumvent technical protection measures, or make the App available to third parties outside the permissions granted by Apple and the Provider.
All rights not expressly granted remain with the Provider or the applicable rightsholder.
6. User-created content and responsibility
Users decide which list names and options they enter into MenuPlinko. This content is stored locally on the user's Mac and is not reviewed or controlled by the Provider.
Users must not use the App in a way that violates applicable law or the rights of third parties. Users are responsible for the decisions they make after receiving a random result and for maintaining any backups they consider necessary.
7. Price, payment, and refunds
The price shown in the Mac App Store at the time of purchase applies. Apple processes the transaction, taxes, payment, invoicing, refunds, and any statutory withdrawal process under the terms and rules applicable to the user's storefront.
Questions concerning a purchase, charge, cancellation, or refund should normally be directed to Apple. This does not restrict any mandatory rights the user may have against the Provider under applicable law.
MenuPlinko currently does not require a subscription or offer In-App Purchases.
8. Availability, maintenance, and updates
The Provider aims to keep MenuPlinko functional on supported systems but cannot promise uninterrupted or error-free operation in every hardware, software, or configuration environment.
The Provider may provide updates that fix errors, maintain security or compatibility, or improve the App. Users should install updates made available through the Mac App Store within a reasonable period. Mandatory statutory obligations to provide updates for digital products remain unaffected.
The Provider may change or remove non-essential features where there is a valid reason, taking into account users' legitimate interests and applicable law. Material changes will be communicated where legally required.
9. Statutory conformity and warranty rights
Mandatory statutory rights relating to digital products, conformity, remedies, and updates remain fully applicable. Nothing in these Terms excludes or reduces rights that cannot legally be waived, including rights under the applicable consumer-protection rules.
If MenuPlinko does not function as described, contact the Provider at info@maxantonschneider.com with the macOS version, App version, and a description of the problem. Purchase or refund matters handled by the Mac App Store may need to be addressed directly to Apple.
10. Liability
The Provider is liable without limitation for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act, and where the Provider has expressly assumed a guarantee or fraudulently concealed a defect.
In cases of slight negligence, the Provider is liable only for breach of an essential contractual obligation whose fulfilment is necessary for proper performance of the agreement and on which the user may regularly rely. In that case, liability is limited to the foreseeable damage typical for this type of agreement.
Any further liability for slight negligence is excluded to the extent permitted by law. Mandatory consumer rights and Apple's obligations under its own applicable terms remain unaffected.
11. Privacy
MenuPlinko processes lists, options, results, and preferences locally on the user's Mac. Details are provided in the MenuPlinko Privacy Policy.
Apple independently processes App Store and transaction data under Apple's own privacy information.
12. Term and termination
The right to use MenuPlinko continues in accordance with the applicable App Store licence and Standard EULA. Licence rights may end where the user materially violates the applicable licence terms or where termination is otherwise permitted by law.
Users may stop using and uninstall the App at any time. Uninstalling the App may not automatically remove every item of local container data or affect purchase records maintained by Apple.
13. Consumer dispute resolution
The Provider is not willing and is not obliged to participate in dispute-resolution proceedings before a consumer arbitration board, unless a legal obligation to participate applies in a specific case.
The European Commission's former Online Dispute Resolution platform was discontinued on July 20, 2025 and is therefore not linked in these Terms.
14. Governing law and jurisdiction
The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive them of mandatory protections granted by the law of the country in which they have their habitual residence.
If the user is a merchant, a legal entity under public law, or a special fund under public law, the Provider's place of business is the exclusive place of jurisdiction to the extent permitted by law. Mandatory statutory jurisdictions remain unaffected.
15. Changes to these Terms
The Provider may update these Terms where necessary to reflect changes in the App, distribution model, law, or applicable Apple terms. Changes do not retroactively remove acquired rights. Material changes will be communicated where required by law.
The version published at the legal-information URL associated with MenuPlinko is the current version.
16. Severability and mandatory law
If an individual provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law. The invalid provision is replaced by the applicable statutory rule. Section 306 of the German Civil Code remains unaffected where applicable.
