Terms and Conditions for MenuRopeBall

These Terms and Conditions apply to the use of the macOS application MenuRopeBall, provided by:

1. Scope

These Terms and Conditions apply to the use of MenuRopeBall.

MenuRopeBall is distributed through Apple's Mac App Store. Your purchase, download, payment, refund, and use of the Mac App Store are also governed by Apple's applicable terms and the applicable App Store end-user licence agreement.

These Terms supplement Apple's applicable terms. Mandatory consumer-protection provisions and mandatory provisions of Apple's applicable terms remain unaffected.

Apple is not the developer or operator of MenuRopeBall.

3. Description of the Application

MenuRopeBall is a macOS menu-bar application that displays an interactive physics ball on the user's desktop.

Depending on the current version and selected settings, its functionality may include:

• dropping or resetting the ball from a menu bar icon;
• dragging, throwing, swinging, and releasing the ball;
• simulating gravity, momentum, rotation, and bouncing;
• attaching the ball to the menu bar with a soft or stiff rope;
• detaching or breaking the rope through interaction;
• selecting from multiple ball appearances;
• configuring the ball's size and bounciness;
• configuring the rope's length, mode, attachment state, and color;
• moving the ball between compatible connected displays;
• hiding or showing the ball; and
• starting automatically when the user logs in.

The precise functionality, system requirements, compatibility information, and available settings are described in the current Mac App Store listing and application interface.

4. Intended Purpose

MenuRopeBall is intended as a lightweight desktop toy and entertainment application.

It is not intended to:

• provide a scientifically exact or authoritative physics simulation;
• measure physical quantities;
• replace professional simulation, engineering, or educational software;
• provide safety-critical functionality;
• monitor the user's work or productivity;
• control other applications, files, or devices; or
• guarantee any particular relaxation, focus, or health benefit.

5. Technical Requirements

MenuRopeBall requires:

• a compatible Mac;
• a supported version of macOS;
• sufficient system resources;
• access to the macOS menu bar; and
• compatible display settings.

The user is responsible for checking the system requirements displayed in the Mac App Store before purchasing or installing the application.

The application's behaviour may be affected by macOS updates, external displays, virtual desktops, display scaling, Stage Manager, full-screen applications, third-party window managers, and changes made by Apple.

6. Licence

Subject to payment of the applicable purchase price and compliance with these Terms and Apple's applicable licence conditions, you receive a limited, non-exclusive, non-transferable right to install and use MenuRopeBall on compatible Apple devices associated with your App Store account, as permitted by Apple's applicable usage rules.

The application is licensed, not sold.

You may not:

• reproduce or distribute the application except where expressly permitted by law or Apple's terms;
• rent, lease, sublicense, sell, or commercially redistribute the application;
• circumvent technical protection mechanisms;
• use unlawful methods to extract, copy, or reproduce substantial parts of the application;
• reverse engineer, decompile, or disassemble the application, except where expressly permitted by mandatory law;
• remove copyright, trademark, or attribution notices; or
• use the application in a way that infringes our rights or the rights of third parties.

7. Purchase and Payment

Purchases are processed through Apple's Mac App Store.

The purchase price shown by Apple at the time of purchase applies. Apple is responsible for processing payments and may apply taxes, regional pricing, currency conversions, or other App Store conditions.

Unless expressly stated otherwise in the current App Store listing, MenuRopeBall is offered as a one-time purchase and does not require a recurring subscription.

Invoices, payment confirmations, billing questions, and App Store payment issues are generally handled through Apple.

8. Withdrawal, Cancellation, and Refunds

Statutory consumer rights remain unaffected.

Where MenuRopeBall is purchased through the Mac App Store, cancellation and refund requests must generally be submitted through Apple and are handled in accordance with Apple's applicable rules and mandatory consumer-protection law.

Nothing in these Terms excludes or restricts a statutory right to withdrawal, refund, repair, replacement, price reduction, termination, or damages where such a right applies.

9. Updates

We may provide updates to:

• fix errors;
• improve performance and compatibility;
• address security or privacy issues;
• adapt MenuRopeBall to changes in macOS;
• comply with legal or App Store requirements; or
• modify or improve the application's functionality.

Updates may require a newer version of macOS or compatible hardware.

Mandatory statutory obligations concerning updates for digital products remain unaffected.

We do not guarantee indefinite compatibility with operating-system versions, hardware, technologies, or interfaces that are no longer supported by Apple.

10. Physics and Interaction Behaviour

MenuRopeBall aims to provide a responsive and playful physics experience.

However, the ball's movement, bounce, spin, rope behaviour, and collisions may occasionally be delayed, interrupted, visually inaccurate, or unavailable. This may occur due to system load, frame-rate changes, display configuration, macOS behaviour, application focus, or software errors.

The simulation is designed for entertainment and must not be relied upon as a scientifically accurate representation of real-world physics.

11. Desktop Overlay

MenuRopeBall uses transparent desktop overlays to display and interact with the ball.

Depending on the user's display and application configuration, the ball may appear above other windows or visual content. The user can hide, reset, or quit the application through the menu bar.

The user is responsible for hiding or quitting MenuRopeBall where the overlay would be distracting, inappropriate, or disruptive, including during presentations, recordings, examinations, accessibility-sensitive workflows, or professional tasks requiring an unobstructed display.

12. Multiple Displays and Virtual Desktops

MenuRopeBall may support movement between compatible connected displays.

The behaviour of the ball may vary depending on:

• the number and arrangement of displays;
• different display resolutions or scaling factors;
• the position of the macOS menu bar;
• virtual desktops and Spaces;
• full-screen applications;
• displays being connected or disconnected; and
• operating-system changes.

We do not guarantee identical physics behaviour across every display configuration.

13. Ball Styles and System Appearance

MenuRopeBall may use symbols or emoji rendered by macOS for certain ball appearances.

Their design, color, size, alignment, and availability may vary between macOS versions, system fonts, languages, and devices. Changes made by Apple to system artwork do not constitute a defect in MenuRopeBall where the application otherwise functions as intended.

14. Start at Login

MenuRopeBall may provide an option to start automatically when the user logs in to macOS.

The user can enable or disable this functionality through MenuRopeBall or the relevant macOS settings. Changes to macOS may affect the availability or behaviour of this feature.

15. Availability and Compatibility

We aim to provide a functional and reliable application but cannot guarantee uninterrupted or error-free operation in every hardware, operating-system, display, and application configuration.

Temporary limitations may result from:

• software errors;
• macOS updates;
• system load or limited resources;
• display changes;
• third-party software;
• unusual window-management configurations; or
• changes made by Apple.

Mandatory rights concerning the conformity of digital products remain unaffected.

16. Prohibited Use

You may not use MenuRopeBall:

• for unlawful purposes;
• to interfere with another person's device, account, or work;
• to conceal malicious activity or content;
• to distribute malware or malicious code;
• to circumvent security controls;
• to infringe intellectual-property or other third-party rights; or
• in a manner that violates Apple's applicable terms.

17. Intellectual Property

MenuRopeBall, its original source code, original artwork, branding, documentation, and other content created by the provider are protected by applicable intellectual-property laws.

No rights are granted except for the limited right to use the application under these Terms and Apple's applicable usage rules.

Third-party and system-provided content remains subject to the rights and terms of the respective rights holders.

18. Third-Party Services

MenuRopeBall is distributed through Apple's Mac App Store and depends on macOS system components.

These services and components are not controlled by us. We are not responsible for Apple's services, payment processing, account management, platform availability, privacy practices, or changes to macOS.

Your use of Apple's services is governed by Apple's own terms and privacy policies.

19. Liability

We are liable without limitation:

• in cases of intent or gross negligence;
• for injury to life, body, or health;
• under applicable product-liability law;
• where a guarantee has expressly been given; and
• in other cases where liability cannot legally be excluded or limited.

In cases of slight negligence, we are liable only for the breach of an essential contractual obligation whose fulfilment is necessary for proper performance of the contract and on which the user may ordinarily rely.

In such cases, liability is limited to foreseeable damage typical for this type of contract.

The above limitations also apply to our legal representatives and agents.

Mandatory consumer rights and liability provisions remain unaffected.

20. Termination of Use

You may stop using and uninstall MenuRopeBall at any time.

Your licence may end if you materially violate these Terms or the applicable App Store licence conditions, subject to applicable law.

Provisions that by their nature should continue after termination, including intellectual-property, liability, and governing-law provisions, remain applicable.

21. Apple-Specific Provisions

You acknowledge that these Terms are concluded between you and the application provider, not Apple.

To the extent required by Apple's applicable terms:

• the application provider, rather than Apple, is responsible for MenuRopeBall and its content;
• Apple has no obligation to provide maintenance or support services for MenuRopeBall;
• the application provider is responsible for addressing claims relating to MenuRopeBall, except where responsibility cannot legally be assigned in this way;
• Apple and its subsidiaries may be third-party beneficiaries of the applicable licence terms; and
• Apple may enforce applicable licence provisions against you.

These provisions do not limit any rights you may have directly against Apple under Apple's own terms or applicable law.

22. Changes to These Terms

We may update these Terms where reasonably necessary because of:

• changes to MenuRopeBall;
• legal or regulatory requirements;
• security or privacy considerations;
• changes to Apple's platform; or
• clarification of existing provisions.

Changes will not retroactively remove rights already acquired by consumers.

Where required, users will be informed of material changes in an appropriate manner.

23. Governing Law

The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law does not deprive them of mandatory protections provided by the law of the country in which they have their habitual residence.

Mandatory rules regarding jurisdiction remain unaffected.

24. Dispute Resolution

We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board, unless a legal obligation to participate applies.

25. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the remaining provisions remain unaffected.

The applicable statutory provision shall take the place of the invalid or unenforceable provision.
