Terms and Conditions for Next5Moves

These Terms and Conditions apply to the use of the macOS application Next5Moves, provided by:

1. Scope
These Terms apply to the use of Next5Moves.
Next5Moves is distributed through Apple’s Mac App Store. Purchases, payments, refunds, downloads, and use of the Mac App Store are also subject to Apple’s applicable terms and licence conditions.
Mandatory consumer rights remain unaffected.
2. Description of the Application
Next5Moves is a macOS productivity and focus utility designed to help users define a desired outcome and the next concrete actions required to complete it.
Users may create outcomes and define up to five upcoming moves for each outcome.
Functionality may include:
- creating and editing outcomes;
- defining up to five moves;
- identifying the current next move;
- marking moves as completed;
- progressing automatically or manually to the next move; and
- displaying relevant progress information.
Next5Moves is intentionally designed as a lightweight focus tool rather than a full project-management or task-management system.
3. User-Entered Information
Next5Moves relies on information entered manually by the user.
The application does not independently verify whether:
- a move has actually been completed;
- an outcome has been achieved;
- the entered information is accurate;
- a particular sequence of moves is appropriate; or
- additional actions are required outside the application.
You are responsible for keeping your outcomes and moves accurate and up to date.
4. Five-Move Limitation
Next5Moves intentionally limits each outcome to a maximum number of upcoming moves as defined by the current version of the application.
This limitation is part of the application's focus-oriented design.
Next5Moves is not intended to replace comprehensive project-management, scheduling, compliance, or workflow-management software.
5. Deadlines and Important Obligations
Next5Moves may be used to organise work relating to projects, clients, launches, content, or other activities.
However, the application should not be relied upon as the sole system for:
- legal deadlines;
- contractual obligations;
- financial deadlines;
- tax deadlines;
- safety-critical tasks;
- medical matters; or
- other time-sensitive obligations where failure to act may result in significant consequences.
You remain responsible for independently monitoring important deadlines and obligations.
6. No Professional Advice
Next5Moves is a general productivity tool.
It does not provide legal, financial, tax, medical, business, project-management, or other professional advice.
Any structure, ordering, or progress information displayed by the application is based on information entered by you and is provided solely as an organisational aid.
7. Licence
Subject to payment of any applicable purchase price and compliance with these Terms and Apple’s applicable rules, you receive a limited, non-exclusive, non-transferable right to use Next5Moves on compatible Apple devices associated with your App Store account.
The application is licensed, not sold.
You may not unlawfully copy, redistribute, sublicense, reverse engineer, circumvent technical protections, or otherwise use Next5Moves contrary to applicable law or Apple’s terms.
8. Purchase and Refunds
Where Next5Moves is offered as a paid application, purchases are processed through Apple’s Mac App Store.
The price displayed by Apple at the time of purchase applies.
Payment processing, billing, cancellations, and refunds are generally handled by Apple.
Statutory consumer rights remain unaffected.
9. Local Data and User Responsibility
Next5Moves is designed to store and process outcomes, moves, and application preferences locally on your Mac.
You are responsible for:
- protecting access to your Mac;
- protecting confidential information entered into the app;
- keeping information current; and
- maintaining appropriate backups where necessary.
We cannot recover application data that is lost, deleted, overwritten, or corrupted on your device.
10. Accuracy and Availability
We aim to provide a reliable application but cannot guarantee completely uninterrupted or error-free operation.
Functionality may be affected by software errors, macOS updates, hardware limitations, corrupted application data, or other technical circumstances.
Important information should be independently verified before relying on it.
11. Updates
We may provide updates to:
- fix errors;
- improve performance;
- maintain compatibility with macOS;
- improve existing functionality;
- add or modify features; or
- address security issues.
Mandatory statutory obligations concerning digital products remain unaffected.
12. Prohibited Use
You may not use Next5Moves:
- for unlawful purposes;
- to store or process information you are not authorised to use;
- to interfere with the application's operation or security;
- to infringe third-party rights; or
- in violation of Apple’s applicable terms.
13. Liability
We are liable without limitation in cases of intent or gross negligence, for injury to life, body, or health, under applicable product-liability law, where a guarantee has expressly been given, and where liability cannot legally be limited.
In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damage typical for this type of contract.
Mandatory statutory liability and consumer rights remain unaffected.
14. Changes and Termination
You may stop using and uninstall Next5Moves at any time.
We may update these Terms where reasonably necessary due to changes to the application, applicable law, Apple’s platform, security requirements, or technical functionality.
Changes will not retroactively remove mandatory consumer rights.
15. Governing Law and Dispute Resolution
The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law does not deprive them of mandatory protections provided by the law of the country in which they have their habitual residence.
Mandatory rules regarding jurisdiction remain unaffected.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board, unless a legal obligation to participate applies.
