Terms and Conditions for SideTray

These Terms and Conditions apply to the use of the macOS application SideTray, provided by:

1. Scope

These Terms and Conditions apply to the use of SideTray.

SideTray is distributed through Apple's Mac App Store.

Your purchase, payment, download, refund, and use of the Mac App Store are additionally governed by Apple's applicable terms and licence conditions.

Mandatory consumer-protection rights remain unaffected.

2. Description of the Application

SideTray is a macOS productivity utility that provides a temporary tray at the edge of the screen.

It allows users to temporarily keep supported content available while switching between applications, windows, or Spaces.

Depending on the current version, supported content may include:

  • files;
  • folders;
  • images;
  • web links;
  • text; and
  • other compatible drag-and-drop content.

The application may also provide functionality for converting clipboard text into a temporary text file.

The precise functionality and system requirements are described in the current Mac App Store listing.

3. Intended Purpose

SideTray is designed as a temporary handoff point for content.

It is not intended to serve as:

  • permanent file storage;
  • a backup solution;
  • cloud storage;
  • a file-recovery system;
  • a document-management system; or
  • an archival service.

Users should retain original files and appropriate backups independently of SideTray.

4. Technical Requirements

Use of SideTray requires a compatible Mac and a supported version of macOS.

Certain functionality may depend on operating-system features, permissions, drag-and-drop compatibility, clipboard behaviour, or the applications used together with SideTray.

Optional functionality involving the Command-V shortcut may require macOS Accessibility permission.

The user is responsible for granting and managing system permissions.

5. Licence

Subject to payment of the applicable purchase price and compliance with these Terms and Apple's applicable licence conditions, you receive a limited, non-exclusive and non-transferable right to use SideTray on compatible Apple devices as permitted by Apple's applicable usage rules.

The application is licensed, not sold.

You may not:

  • unlawfully reproduce or distribute the application;
  • rent, sublicense, or commercially redistribute it;
  • circumvent technical protection measures;
  • reverse engineer, decompile, or disassemble it except where permitted by mandatory law;
  • remove copyright or attribution notices; or
  • use the application in a manner that infringes applicable law or third-party rights.

6. Purchase and Payment

Purchases are processed through Apple's Mac App Store.

The purchase price displayed by Apple at the time of purchase applies.

Unless expressly stated otherwise in the current App Store listing, SideTray is offered as a one-time purchase without a recurring subscription.

Payment processing, invoices, regional pricing, taxes, currency conversion, and App Store billing are generally handled by Apple.

7. Refunds and Consumer Rights

Statutory consumer rights remain unaffected.

Where SideTray is purchased through the Mac App Store, refund and cancellation requests are generally processed through Apple in accordance with Apple's applicable rules and mandatory consumer-protection law.

Nothing in these Terms excludes rights that cannot legally be excluded.

8. Temporary Content

SideTray is designed for temporary content handling.

Items displayed in SideTray may no longer be available after they are removed, after SideTray is cleared, after the application is quit, or where temporary files are deleted.

The user is responsible for retaining original files and any information that must be preserved.

SideTray must not be relied upon as the sole storage location for important information.

9. Clipboard Content

If the clipboard functionality is used, SideTray may create a temporary file from clipboard text.

The user is responsible for ensuring that they have the right to process, copy, move, or distribute content placed into the application.

Users should exercise particular care with confidential, personal, copyrighted, or otherwise protected information.

10. Third-Party Applications

SideTray may be used together with other macOS applications.

The developer does not control third-party applications and cannot guarantee that every application will accept every type of dragged content.

Third-party applications may independently process files or information dropped into them.

Their functionality, privacy practices, and availability are governed by their respective providers.

11. Updates and Compatibility

Updates may be provided to:

  • fix bugs;
  • improve performance;
  • improve compatibility;
  • address security or privacy issues;
  • adapt SideTray to macOS changes;
  • comply with legal or App Store requirements; or
  • modify or improve functionality.

Updates may require a newer version of macOS or compatible hardware.

We do not guarantee indefinite compatibility with operating systems, hardware, APIs, permissions, or technologies no longer supported by Apple.

Mandatory statutory obligations concerning digital products remain unaffected.

12. Availability

We aim to provide a reliable application but cannot guarantee uninterrupted or error-free operation in every environment.

Temporary limitations may result from factors including:

  • macOS updates;
  • software errors;
  • permission changes;
  • third-party applications;
  • unsupported file formats;
  • system configuration;
  • hardware limitations; or
  • changes to Apple technologies.

13. Liability

We are liable without limitation where liability cannot legally be excluded or limited, including in cases of intent or gross negligence and for injury to life, body, or health.

In cases of slight negligence, liability is limited, where legally permissible, to breaches of essential contractual obligations whose fulfilment is necessary for the proper performance of the contract and on which the user may ordinarily rely.

In such cases, liability is limited to foreseeable damage typical for this type of contract.

Mandatory consumer rights and statutory liability provisions remain unaffected.

14. Governing Law

The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law does not deprive them of mandatory protections provided by the law of the country in which they have their habitual residence.

Mandatory rules concerning jurisdiction remain unaffected.

15. Dispute Resolution

We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board unless participation is required by law.

16. Changes to These Terms

These Terms may be updated where reasonably necessary due to changes to SideTray, applicable law, security or privacy requirements, or Apple's platform.

Changes will not retroactively remove rights already acquired by consumers.
