Terms and Conditions for VibeView

These Terms and Conditions apply to the use of the macOS application VibeView, provided by:

1. Scope

These Terms and Conditions apply to the use of VibeView.

Where VibeView is obtained through Apple's Mac App Store or another authorized distribution platform, your purchase, download, payment, refund, and use of that platform are also governed by the platform's applicable terms and end-user licence agreement.

These Terms supplement the applicable platform terms. Mandatory consumer-protection provisions and mandatory platform provisions remain unaffected.

2. Provider

Apple and other distribution platforms are not the developer or operator of VibeView.

3. Description of the Application

VibeView is a macOS menu bar utility that arranges eligible visible application windows side by side on the active display.

Depending on the current version and selected settings, its functionality may include:

  • arranging visible windows with a keyboard shortcut;
  • distributing eligible windows evenly across the usable display area;
  • restoring the previous window layout;
  • selecting window gaps and screen padding;
  • identifying the display containing the focused window;
  • excluding selected applications from arrangement;
  • configuring arrangement and restoration shortcuts; and
  • launching automatically when the user logs in.

The precise functionality, system requirements, compatibility information, and available settings are described in the current product listing and app interface.

4. Intended Purpose

VibeView is intended to help users organize their desktop workspace and view multiple applications at the same time.

It is not intended to:

  • create a permanent or authoritative record of window positions;
  • guarantee preservation of unsaved work;
  • control true full-screen spaces;
  • bypass macOS security or application restrictions;
  • supervise or monitor another person;
  • provide backup, disaster-recovery, or document-management functionality; or
  • guarantee a particular productivity or commercial outcome.

5. Technical Requirements and Permissions

VibeView requires:

  • a compatible Mac;
  • a supported version of macOS;
  • sufficient system resources;
  • macOS Accessibility permission; and
  • applications whose windows expose the necessary macOS accessibility attributes and permit movement and resizing.

The user is responsible for granting and managing Accessibility permission through macOS.

If permission is denied or withdrawn, VibeView may be unable to provide some or all core functionality.

The user is responsible for checking the system requirements displayed at the point of purchase or download before installing the app.

6. Licence

Subject to payment of the applicable purchase price, where required, and compliance with these Terms and the applicable distribution-platform licence, you receive a limited, non-exclusive, non-transferable, and revocable right to install and use VibeView on compatible devices as permitted by the applicable usage rules.

The application is licensed, not sold.

You may not:

  • reproduce or distribute the app except where expressly permitted by law or applicable platform terms;
  • rent, lease, sublicense, sell, or commercially redistribute the app;
  • circumvent technical protection mechanisms;
  • reverse engineer, decompile, or disassemble the app except where expressly permitted by mandatory law;
  • remove copyright, trademark, or attribution notices; or
  • use the app in a manner that infringes our rights or third-party rights.

7. Purchase and Payment

Purchases made through the Mac App Store are processed by Apple. Purchases made through another authorized platform are processed by that platform or its payment provider.

The price displayed at the time of purchase applies. The relevant provider may apply taxes, regional pricing, currency conversion, and other conditions.

Unless expressly stated otherwise in the current listing, VibeView is offered as a one-time purchase and does not require a recurring subscription.

Invoices, payment confirmations, billing questions, and payment issues are generally handled by the platform or payment provider that processed the transaction.

8. Withdrawal, Cancellation, and Refunds

Statutory consumer rights remain unaffected.

Where VibeView is purchased through the Mac App Store or another distribution platform, cancellation and refund requests must generally be submitted through that platform and are handled according to its applicable rules and mandatory consumer-protection law.

Nothing in these Terms excludes or restricts a statutory right to withdrawal, refund, repair, replacement, price reduction, termination, or damages where such a right applies.

9. Updates

We may provide updates to fix errors, improve performance or compatibility, address security or privacy issues, adapt to changes in macOS, comply with legal or platform requirements, or modify app functionality.

Updates may require a newer version of macOS or compatible hardware.

Mandatory statutory obligations concerning updates for digital products remain unaffected. We do not guarantee indefinite compatibility with operating-system versions, hardware, technologies, permissions, or applications no longer supported by Apple or their respective providers.

10. Window Access and Local Processing

VibeView must identify eligible running applications and access technical window information to provide its functionality.

This may include application names and bundle identifiers, process identifiers, window roles, full-screen or minimized status, position, size, and display assignment.

This processing takes place locally on the user's Mac. Details are provided in the Privacy Policy.

11. Layout Restoration

VibeView may temporarily retain the previous position and size of eligible windows so that the user can restore the preceding layout.

Restoration is a convenience feature, not a backup system. A previous layout may not be fully restorable if, for example:

  • an application or window has been closed;
  • macOS or the relevant application refuses a position or size change;
  • a display has been disconnected or its configuration has changed;
  • window minimum-size restrictions have changed;
  • the app has terminated or its temporary snapshot is no longer available; or
  • another application has changed the window state.

12. Arrangement Limitations

VibeView aims to arrange eligible windows evenly but cannot guarantee identical results in every environment.

Some windows may be skipped, positioned differently, or resized imperfectly because of:

  • macOS Accessibility restrictions;
  • true full-screen spaces;
  • non-resizable windows or system dialogs;
  • application-specific minimum window sizes;
  • applications that do not expose their windows through the Accessibility API;
  • hidden or minimized application state;
  • multiple-display geometry;
  • display scaling or resolution changes;
  • operating-system updates; or
  • changes made by other applications.

13. Active Display and Multiple Monitors

VibeView attempts to identify the display containing the currently focused window. If this cannot be determined, macOS may provide a fallback display.

The user must verify the target display before triggering an arrangement where moving windows could disrupt an important workflow, presentation, or recording.

We do not guarantee identical behaviour for every display arrangement, virtual display, remote desktop, or screen-sharing configuration.

14. Keyboard Shortcuts

Global keyboard shortcuts may be affected by keyboard layout, input method, custom key mapping, accessibility settings, other applications, or macOS updates.

The user is responsible for selecting shortcuts that do not conflict with important commands in other applications.

We do not guarantee that every key combination is available or interpreted identically on every keyboard and language configuration.

15. Excluded Applications

VibeView may allow the user to exclude selected applications from arrangement. The exclusion list is based on technical application identifiers and may be affected by application replacement, reinstallation, bundle-identifier changes, or system restrictions.

The user is responsible for checking that important applications are correctly excluded before triggering an arrangement.

16. User Responsibility

The user is responsible for:

  • saving important work before rearranging windows;
  • checking the target display and eligible windows;
  • selecting appropriate gaps, padding, and shortcuts;
  • managing Accessibility and login-item permissions;
  • reviewing excluded applications;
  • maintaining a compatible macOS environment; and
  • using the app in compliance with applicable laws and third-party rights.

VibeView does not alter the contents of documents, but moving or resizing windows may affect the user's visual workspace or application state.

17. Third-Party Applications

VibeView interacts with windows belonging to third-party applications through interfaces provided by macOS.

Those applications are not controlled by us. We are not responsible for their availability, functionality, window behaviour, accessibility support, privacy practices, or compatibility with VibeView.

Third-party application names and technical identifiers displayed by VibeView remain the property of their respective owners. Their display does not imply affiliation or endorsement.

18. Prohibited Use

You may not use VibeView:

  • for unlawful purposes;
  • to interfere with another person's device, account, or work;
  • to circumvent macOS security controls;
  • to violate privacy, employment, confidentiality, or data-protection laws;
  • to infringe intellectual-property rights;
  • to distribute malware or malicious code; or
  • in a manner that violates applicable Apple or distribution-platform terms.

19. Availability and Compatibility

We aim to provide a functional and reliable application but cannot guarantee uninterrupted or error-free operation in every hardware, operating-system, display, and application configuration.

Temporary limitations may result from software errors, macOS updates, permission changes, hardware limitations, third-party software, unusual display arrangements, or changes made by Apple.

Mandatory rights concerning the conformity of digital products remain unaffected.

20. Liability

We are liable without limitation:

  • in cases of intent or gross negligence;
  • for injury to life, body, or health;
  • under applicable product-liability law;
  • where a guarantee has expressly been given; and
  • where liability cannot legally be excluded or limited.

In cases of slight negligence, we are liable only for breach of an essential contractual obligation whose fulfilment is necessary for proper performance of the contract and on which the user may ordinarily rely.

In such cases, liability is limited to foreseeable damage typical for this type of contract.

These limitations also apply to our legal representatives and agents. Mandatory consumer rights and liability provisions remain unaffected.

21. No Guarantee of Productivity or Workflow Suitability

VibeView is a workspace convenience tool.

We do not guarantee that it will be suitable for safety-critical operations, accessibility certification, evidentiary purposes, uninterrupted presentations, professional broadcast environments, automated testing, or any purpose requiring exact and permanent window placement.

The user remains responsible for reviewing the resulting workspace and approving it for the intended use.

22. Termination of Use

You may stop using and uninstall VibeView at any time.

Your licence may end if you materially violate these Terms or applicable distribution-platform licence conditions, subject to applicable law.

Provisions that by their nature should continue after termination, including intellectual-property, liability, and governing-law provisions, remain applicable.

23. Apple-Specific Provisions

Where VibeView is distributed through Apple's Mac App Store, you acknowledge that these Terms are concluded between you and the app provider, not Apple.

To the extent required by Apple's applicable terms:

  • the app provider, rather than Apple, is responsible for VibeView and its content;
  • Apple has no obligation to provide maintenance or support services for VibeView;
  • Apple is not responsible for claims concerning VibeView except where required by law;
  • Apple and its subsidiaries may be third-party beneficiaries of applicable licence terms; and
  • Apple may enforce applicable licence provisions against you.

These provisions do not limit rights you may have directly against Apple under Apple's own terms or applicable law.

24. Changes to These Terms

We may update these Terms where reasonably necessary because of changes to VibeView, legal or regulatory requirements, security or privacy considerations, changes to Apple's platform, or clarification of existing provisions.

Changes will not retroactively remove rights already acquired by consumers. Where required, users will be informed of material changes in an appropriate manner.

25. Governing Law

The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law does not deprive them of mandatory protections provided by the law of the country in which they have their habitual residence.

Mandatory rules regarding jurisdiction remain unaffected.

26. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board, unless a legal obligation to participate applies.

27. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the remaining provisions remain unaffected.

The applicable statutory provision shall take the place of the invalid or unenforceable provision.
